These terms govern your use of the Delvia app and web app (app.delvia.health), operated by Simak Labs Ltd, a company registered in England and Wales under company number 17449816, with its registered office at 71–75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom (support@simak.ai). By creating an account you agree to them.

1. What Delvia is and is not

Delvia is an informational and organizational tool: it stores the health information you choose to record and uses AI to explain and organize it in plain language.

Delvia is not a medical device and does not provide medical advice. It does not diagnose, treat, cure, or prevent any medical condition, and it never replaces the judgment of a qualified healthcare professional. Always consult your doctor before making medical decisions. If you may be experiencing a medical emergency, contact your local emergency services immediately.

2. AI-generated content

  • Explanations in the app are generated by AI and may be incomplete or wrong. Verify anything important with your doctor.
  • Delvia may highlight a value that looks urgent and suggest seeing a doctor promptly. That is a prompt to check, not a diagnosis, and it can be wrong in both directions: the absence of a warning does not mean a result is normal or safe.
  • Every AI response carries a "not medical advice" notice and a Report action. We review reports and use them to improve our safeguards.
  • You must not attempt to use Delvia to obtain diagnosis, treatment, or prescription decisions.
  • Deep analysis, on Delvia Max, runs every answer at the highest reasoning setting. It changes how much reasoning the AI applies, not what the AI is: its answers can still be incomplete or wrong, and nothing in these terms promises a better result.

3. Your account

  • You must be 18 or older to hold an account.
  • Keep your credentials confidential; you are responsible for activity on your account.
  • Your account stays signed in on one device or browser at a time; signing in elsewhere signs the previous one out.
  • Only upload health information that is yours, or that you are clearly authorized to manage.
  • People you add. Delvia Premium and Delvia Max let you keep records for other people, such as a parent, a partner or a child, who may be under 18. You may add a person only if you are authorized to: you are their parent or legal guardian, or they have consented to you keeping their health records in Delvia. By adding a person you warrant that you are, and you are responsible for the information you record about them. A child's records are kept by you as their parent or guardian; the child has no account of their own.
  • Removing a person from your account deletes their records permanently. It cannot be undone.
  • Provide accurate information because the quality of what Delvia organizes depends on it.

4. AI usage quota and paid plans

  • Free accounts are for one person and include a weekly weighted-token quota. Metered usage reflects model input plus output and thinking tokens weighted for their higher processing cost.
  • The paid plans are subscriptions, each monthly or annual: Delvia Personal for one person, and Delvia Premium and Delvia Max, which hold more people and a larger weekly token quota shared by everyone on the account. Delvia Max also includes Deep analysis (see section 2). The current allowances, people limits and prices are shown on our website and in the app. Quotas reset weekly on every plan; unused quota does not roll over and has no cash value. Background summaries and conversation compaction are not deducted.
  • If you subscribe in the Android app, the subscription is billed through Google Play. If you subscribe in the iOS app, it is sold and billed by Apple through the App Store as the merchant of record, under Apple's own terms. If you subscribe on the web, it is sold to you by Paddle as the merchant of record: your purchase contract for the subscription is with Paddle, which handles payment, taxes, invoices and refunds under its own buyer terms. These terms still govern your use of Delvia.
  • Changing plans. An upgrade to a higher plan, such as from Delvia Personal to Delvia Premium, takes effect immediately, wherever you subscribed. For a subscription bought through Google Play or the App Store, a downgrade takes effect at the end of the period you have already paid for and is made in that store; in the App Store, so does a switch between monthly and annual billing on the same plan. For a subscription bought on the web, any change of plan, up or down, takes effect immediately, and Paddle prorates the difference in price. When your plan changes to one that holds fewer people, the people beyond its limit stay on your account as read-only: you can still see their records but not add to or change them, and they are never deleted because of the change.
  • Subscriptions renew automatically until you cancel. Details on cancellation, the 14-day refund window and refunds are set out in section 5.
  • We may adjust pricing or future weekly allowances prospectively. The allowance snapshotted for an already-started week is not silently reduced.

5. Refunds and cancellation

  • Cancelling a subscription. You can cancel your subscription at any time: in your Google Play subscriptions for a subscription bought in the Android app, in your App Store subscriptions for one bought in the iOS app, or in the web app under Profile → Manage subscription for one bought on the web. Cancelling stops future renewals, and you retain access to your plan until the end of the billing period you have already paid for. Apart from the 14-day refund window below, we do not provide prorated refunds for partial billing periods or unused token allowances. Deleting the app does not cancel a subscription. Deleting your account cancels a subscription bought on the web, but not one bought through Google Play or the App Store (which must be cancelled in the respective store).
  • 14-day refund window. If you subscribe on the web, you may cancel your initial subscription and request a full refund within 14 days of purchase for any reason. If you need a refund or wish to cancel within this window, simply contact us at support@simak.ai from the email address registered to your Delvia account, and our team will gladly assist you.
  • Who handles your refund. If you subscribed on the web, Paddle acts as the merchant of record and issues approved refunds back to your original payment method. If you subscribed in the Android app or iOS app, refunds are handled exclusively by Google Play or Apple respectively under their store policies, and any request must be submitted directly to that store.
  • Faulty service and statutory rights. If the service has a material defect that we cannot remedy within a reasonable timeframe, you may be entitled to a remedy under applicable law. Nothing in these terms limits your statutory consumer rights.

6. Acceptable use

You agree not to misuse the service, including attempting to breach its security, probing other users' data, reverse-engineering the app, scraping, reselling access, sending unlawful content, or using automated tools to exhaust the AI service.

7. Your data

Your health data belongs to you, and the records you keep for someone else belong to that person. How we handle both is described in the Privacy Policy, which is part of these terms. You can export your data or delete your account in the app or via the account deletion page at any time.

The AI behind your answers. Delvia's explanations are written by an AI model that a specialist AI provider runs for us. So that it can answer you, the messages and files you send are passed to that provider, together with the health details they contain, including those of the people you add. They are used to prepare your answers and are never used to train the provider's models. By creating an account you agree to this. The provider is named in our Privacy Policy.

8. Termination

You can stop using Delvia and delete your account whenever you like. We may suspend or terminate accounts that violate these terms or abuse the service; where reasonable, we will warn you first.

9. Disclaimers and liability

The service is provided "as is". To the maximum extent permitted by law, Simak Labs Ltd is not liable for indirect or consequential damages, or for decisions made in reliance on AI-generated content.

To the maximum extent permitted by law, the total liability of Simak Labs Ltd for all claims arising from the service in any twelve-month period is limited to the greater of the amount you paid us in the twelve months before the claim and USD 50.

Nothing in these terms limits liability that cannot lawfully be limited, or your statutory consumer rights.

10. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute arising from them. If you live in a country whose consumer law gives you protections that cannot be waived by agreement, you keep those protections and may also bring a claim in the courts of that country.

11. Changes

We may update these terms; material changes will be announced in the app. Continuing to use Delvia after a change means you accept the updated terms. The current version always lives at this address.
